Terms and Conditions

These Terms and Conditions govern purchases made through the Oceana Fisheries online store at shop.oceanafisheries.com.

By accessing the Website, creating an account or placing an order, you confirm that you have read and agreed to these Terms and Conditions.

In these Terms and Conditions, “Oceana Fisheries”, “we”, “us” and “our” refer to Oceana Fisheries Company (Pty) Ltd. “Customer”, “you” and “your” refer to the person placing an order through the Website.

2. Products

We sell seafood and other products displayed on the Website.

We take reasonable care to ensure that product descriptions, photographs, pack sizes and other information displayed on the Website are accurate. However, photographs are provided for illustration purposes, and the appearance, colour, shape or presentation of natural products may vary.

Unless otherwise stated on the relevant product page, seafood products are sold in fixed-weight packs at fixed prices.

The pack weight, storage condition and whether a product is fresh, chilled or frozen will be stated on the relevant product page or product packaging.

Customers are responsible for reviewing product descriptions, ingredients, allergen information and storage instructions before placing an order or consuming a product.

Fish and seafood may contain bones, shells or shell fragments despite reasonable preparation and inspection.

3. Availability

All products are subject to availability.

Adding a product to a shopping cart does not reserve the product. If a product becomes unavailable after an order has been submitted, we will contact the Customer and offer one of the following:

  • removal of the unavailable product and a refund for that product;
  • an alternative product, subject to the Customer’s agreement; or
  • cancellation and refund of the affected order.

We will not substitute a different fish species, product, pack size or brand without the Customer’s agreement.

4. Prices

Prices are displayed in Seychelles Rupees, unless another currency is clearly stated on the Website.

The price payable is the price displayed when the order is submitted, together with any applicable delivery charge.

Delivery charges will be shown before the Customer confirms payment.

We reserve the right to change prices at any time. Price changes will not affect orders already accepted by us.

If an obvious pricing or technical error occurs, we may contact the Customer to correct the order or cancel the affected item. Any amount already paid for a cancelled item will be refunded.

5. Placing an Order

Before submitting an order, the Customer must check:

  • the selected products and quantities;
  • the delivery address;
  • the recipient’s name and telephone number;
  • the total price and delivery charge; and
  • the requested delivery details.

The Customer is responsible for ensuring that all information provided is complete and accurate.

Submitting an order constitutes an offer to purchase the selected products. An order is accepted only when we issue an order confirmation or otherwise confirm that the order has been accepted for preparation.

An automated acknowledgement that an order has been received does not necessarily mean that the order has been accepted.

We may refuse or cancel an order where:

  • a product is unavailable;
  • payment is not authorised;
  • the delivery address is outside our delivery area;
  • the order information appears incomplete, incorrect or fraudulent;
  • there is an obvious pricing or product-information error;
  • fulfilling the order would breach applicable law; or
  • circumstances outside our reasonable control prevent fulfilment.

Where an order is cancelled after payment, the applicable amount will be refunded to the original payment method.

6. Payment

Payment is accepted by card through the approved online payment gateway.

The Customer must be authorised to use the card submitted for payment.

Orders will not be processed until payment has been authorised or confirmed.

Card payments may be subject to additional security checks or authentication required by the issuing bank or payment-gateway provider.

We are not responsible for payment being refused by the Customer’s bank, card issuer or payment provider.

We do not charge any additional card-processing fee unless such a fee is clearly disclosed before payment.

7. Order Changes and Cancellations

Because seafood and other perishable products may be prepared specifically for an order, cancellation rights may depend on whether preparation or dispatch has started.

The conditions for changing or cancelling an order are set out in our separate Cancellation and Refund Policy, which forms part of these Terms and Conditions.

A cancellation request is not effective until it has been acknowledged by Oceana Fisheries.

Nothing in these Terms and Conditions limits any mandatory rights available to the Customer under Seychelles law.

8. Delivery Area

Online orders are delivered only to addresses on Mahé Island, Seychelles.

We do not currently deliver online orders to Praslin, La Digue, the outer islands or addresses outside Seychelles.

An order submitted with an address outside the available delivery area may be rejected or cancelled and refunded.

9. Delivery Service

Deliveries are carried out by an independent third-party delivery provider appointed by Oceana Fisheries.

The delivery provider collects completed orders from our facility and transports them to the delivery address provided by the Customer.

Delivery areas, charges, available time periods and estimated delivery times will be shown on the Website or during checkout.

Delivery times are estimates and are not guaranteed. Deliveries may be affected by traffic, weather, road conditions, access restrictions, order volumes and other circumstances outside our reasonable control.

Further delivery conditions are set out in our separate Delivery Policy, which forms part of these Terms and Conditions.

10. Customer Responsibilities for Delivery

The Customer must provide:

  • a complete and accurate delivery address;
  • a working telephone number;
  • any necessary directions or access instructions; and
  • the name of the person authorised to receive the order.

The Customer or an authorised recipient must be available to receive the order during the arranged delivery period.

The delivery provider may contact the Customer to confirm the address, obtain directions or arrange completion of the delivery.

Where delivery cannot be completed because the Customer is unavailable, cannot be contacted, provides an incorrect address or fails to provide access, the Customer may be responsible for reasonable redelivery charges.

Because the products may be perishable, a refund may not be available where an order becomes unsuitable for sale or consumption because of the Customer’s failure to receive it. This does not affect the Customer’s statutory rights where the failure was caused by Oceana Fisheries or the delivery provider.

11. Completion of Delivery

Delivery is completed when the order is handed to the Customer, an authorised recipient or another person reasonably appearing to be authorised to receive it at the delivery address.

We or the delivery provider may request the recipient’s name, signature, confirmation code, photograph or other reasonable proof of delivery.

Responsibility for the products passes to the Customer once delivery has been completed.

Where the Customer specifically instructs that an order be left unattended at a particular location, delivery may be treated as completed when the order is left in accordance with those instructions. The Customer accepts the risks arising after the unattended delivery has been completed.

We may refuse to leave perishable products unattended where doing so could create a food-safety or security risk.

12. Inspection and Storage

Customers should inspect the order promptly upon delivery.

Fresh, chilled and frozen products must be stored immediately in accordance with the instructions on the packaging or product page.

The Customer is responsible for maintaining appropriate storage conditions after delivery has been completed.

Products should not be consumed if the packaging is damaged, the product appears unsafe, or there are reasonable concerns about its temperature, condition or quality.

Any missing, incorrect, damaged, spoiled or temperature-affected product should be reported to Oceana Fisheries as soon as reasonably possible in accordance with the Cancellation and Refund Policy.

Customers may be asked to provide photographs, packaging information, proof of purchase or other reasonable information required to assess the complaint.

13. Allergies and Dietary Requirements

Fish, shellfish and other seafood are common allergens.

Customers with allergies or specific dietary requirements are responsible for reviewing the information displayed on the Website and product packaging before ordering or consuming a product.

Our products may be processed, prepared, packaged or stored in facilities where fish, crustaceans, molluscs and other allergens are present. We cannot guarantee the complete absence of cross-contact unless expressly stated for a particular product.

Customers should contact us before ordering where clarification about ingredients or allergens is required.

14. Product Quality and Complaints

We aim to supply products that correspond with their descriptions and are suitable for sale and consumption when properly handled and stored.

Where a product is incorrect, missing, damaged, spoiled, unsafe or otherwise does not meet applicable requirements, the Customer should contact us using the details below.

Depending on the circumstances and applicable law, we may provide:

  • a replacement product;
  • a refund;
  • a partial refund;
  • a store credit, where accepted by the Customer; or
  • another appropriate remedy.

Any remedy will be determined in accordance with our Cancellation and Refund Policy and applicable Seychelles law.

15. Promotions and Discount Codes

Promotional offers and discount codes may be subject to separate conditions, including validity periods, minimum-order amounts, eligible products and usage limits.

Unless otherwise stated:

  • promotional offers cannot be exchanged for cash;
  • only one discount code may be used per order;
  • discount codes may not be used after their expiry date; and
  • promotional offers are subject to product availability.

We may withdraw or correct a promotion where it has been published in error, subject to any rights already acquired by Customers under accepted orders.

16. Website Accounts

Where the Website allows Customer accounts, the Customer is responsible for keeping login details confidential and for activity conducted through the account.

The Customer must notify us promptly if they believe that their account has been accessed or used without authorisation.

We may suspend or close an account that is used fraudulently, unlawfully or in breach of these Terms and Conditions.

Customers may also place orders without an account where guest checkout is made available.

17. Acceptable Use of the Website

The Website must not be used:

  • for unlawful or fraudulent activity;
  • to interfere with the operation or security of the Website;
  • to introduce viruses, malicious code or harmful technology;
  • to obtain unauthorised access to systems or customer information;
  • to place false or abusive orders; or
  • to copy or commercially exploit Website content without permission.

We may restrict access to the Website where reasonably necessary to protect our business, customers, systems or legal rights.

18. Intellectual Property

The Website and its contents, including text, logos, photographs, graphics, product descriptions and software, are owned by or licensed to Oceana Fisheries unless otherwise stated.

Website content may be viewed and used for personal, non-commercial purposes connected with purchasing our products.

No Website content may be reproduced, distributed, modified or commercially used without our prior written permission.

19. Website Availability

We aim to keep the Website accurate, secure and available. However, we do not guarantee that the Website will always operate without interruption or error.

We may suspend access temporarily for maintenance, security, updates or circumstances outside our reasonable control.

We are not responsible for losses caused solely by temporary Website unavailability where we have taken reasonable steps to restore the service.

20. Liability

Nothing in these Terms and Conditions excludes or limits liability that cannot lawfully be excluded or limited under Seychelles law.

We remain responsible for fulfilling accepted orders and for dealing with complaints concerning products or delivery arranged through our Website, including where a third-party delivery provider is used.

We are not responsible for loss or damage caused by:

  • information supplied incorrectly by the Customer;
  • the Customer’s failure to follow storage or handling instructions;
  • unauthorised use of the Customer’s card or Website account where the loss was not caused by our failure to take reasonable security measures;
  • use of a product contrary to its stated purpose or instructions; or
  • circumstances outside our reasonable control.

To the extent permitted by law, we are not liable for indirect or consequential business losses arising from a consumer purchase.

21. Events Outside Our Control

We will not be responsible for delays or failure to perform an obligation where caused by circumstances outside our reasonable control, including severe weather, flooding, road closures, power or telecommunications failures, equipment breakdown, supply interruption, public emergencies, government restrictions or industrial action.

Where such circumstances affect an order, we will take reasonable steps to contact the Customer and arrange delivery, replacement, cancellation or refund as appropriate.

22. Personal Information

Personal information submitted through the Website will be processed in accordance with our separate Privacy Policy.

Information necessary to complete an order may be shared with service providers involved in payment processing, website operation, customer communication and delivery.

In particular, the Customer’s name, telephone number, delivery address, directions and relevant order information may be shared with the appointed delivery provider for the purpose of completing delivery.

23. Changes to These Terms

We may update these Terms and Conditions to reflect changes to our business, Website, payment arrangements, delivery service or legal requirements.

The version applicable to an order is the version published on the Website when that order is submitted.

Material changes will not apply retrospectively to orders already accepted unless required by law or agreed with the Customer.

24. Governing Law and Disputes

These Terms and Conditions and all purchases made through the Website are governed by the laws of the Republic of Seychelles.

Customers should first contact Oceana Fisheries so that we can attempt to resolve any complaint promptly.

Nothing in these Terms and Conditions prevents a Customer from referring a matter to the Fair Trading Commission, another competent authority or a court or tribunal with jurisdiction in Seychelles.
